A friend of Grant’s [the man killed by BART cops] who was with him on the crowded Oakland train station platform at the time of the shooting said Grant pleaded with officers not to harm him.
“Oscar yelled, ‘You shot me! I got a four-year-old daughter,”‘ said Fernando Anicete. “Oscar was telling us to calm down and we did. We weren’t looking for any trouble.”
Burris claims the shooting was intentional, and that he planned to ask Alameda County prosecutors to seek criminal charges against the officer. Burris said Grant, of Hayward, Calif., posed no threat to officers when a bullet entered his back and ricocheted to his lung area, killing him almost instantly.
“The officer leaned (in), was straddling over him and pointed his gun directly into the backside and shot (Grant),” said Burris, adding that Grant was handcuffed — after he was shot. “This was not a deadly force situation.”

Relatives of a man who claim he was shot in the back and killed by a policeman while lying unarmed on the ground are suing the officer's employers for $25m.

The shooting of Oscar Grant, 22, early on New Year's Day at a busy train station in Oakland, California, sparked widespread outrage. The incident was caught on video by at least three witnesses.
Footage shows Bay Area Rapid Transit police officers responding to a call about two groups of men fighting on a train around 2am on January 1. The officers put several of the young men on the ground against a wall on the station platform.
Mr Grant, who was travelling home after celebrating New Year's Eve in San Francisco, can be seen rising to his knees before being pushed back down by police. According to local television news reports, at least one of the home videos shows an officer putting his knee on Mr Grant before a colleague draws his gun and fires. Mr Grant, a butcher at an Oakland supermarket, died later that morning.

In a dramatic story that has been stoked by amateur YouTube videos, the aftermath of the fatal New Year's Day shooting of a young man by a BART officer unfolded Wednesday on several fronts - with protests, a funeral and an announcement that the officer had resigned.
Late Wednesday, Oakland police responded to scattered disturbances as hundreds of protesters gathered around the Lake Merritt BART station, overturned trash cans, lit a dumpster on fire and rocked a police car back and forth. Police used tear gas to disperse the crowd. It was unclear whether there were any arrests or injuries.
Earlier that day, more than 1,000 people turned out at a Hayward church to remember Oscar Grant III , who one worshipper called "the apple of God's eyes.'' Cell phone videos apparently show Grant face down being shot by an officer standing over him.
On the same day, as word spread that Officer Johannes Mehserle had quit the force, about 50 protesters met with Alameda County District Attorney Tom Orloff to demand that his office file charges against Mehserle in the shooting at the Fruitvale BART station. After initially resisting, Orloff let the protesters into his office, but excluded about a dozen members of the press waiting outside in the lobby. The group included 10 local pastors, Alameda County Supervisor Keith Carson, and Oakland City Councilmember Desley Brooks, who has called Grant's death "an execution.''
BART officials announced Wednesday that Mehserle, 27, had resigned.
